Data Controller and Contact

otto schachner nordic ApS, Prinsessens Kvarter 2, Tårup, 7000 Fredericia, CVR no. 42946702, is the data controller for the processing of your personal data (hereinafter referred to as “we” or “us”).

Categories of information

When you contact us, we may, depending on the purpose of the contact, process the following information about you:

  • Contact details (e.g., phone number/email)
  • IP address
  • Salary and other personnel matters
  • General application and CV information
  • Health information

Purpose

Our processing of your personal data may be for the following purposes:

  • Handling customer and supplier relationships
  • Handling inquiries via our website and webshop
  • Handling recruitment
  • Personnel administration

Basis for processing

We only process your personal data if there is a legal basis for the processing. The basis can be the following:

  • We process information about how visitors use our website based on our legitimate interest in improving our website, products, and other services, as well as our legitimate interest in marketing our company, cf. GDPR Article 6, paragraph 1, letter f
  • Contact via Webshop/inquiries via website: it is our legitimate interest to be able to contact customers and suppliers, cf. GDPR Art. 6, paragraph 1, letter f, or to the extent necessary to enter into or fulfill a contract with them, cf. GDPR Art. 6, paragraph 1, letter b
  • Recruitment: we process personal data based on a balancing of interests, cf. GDPR Article 6, paragraph 1, letter f, as we have a legitimate interest in processing job applications, etc., that precede the interests of the data subject.
  • Personnel data: general personal data about employees are necessary for the employment relationship, cf. GDPR Art. 6, paragraph 1, letter b.
  • Customer and supplier relationships: processing is necessary for the conclusion or fulfillment of a contract, cf. GDPR Article 6, paragraph 1, letter b

Deletion of personal data

Your personal data are stored only as long as there is a basis for our processing of the data.

Unless there is another legal basis, we delete your personal data within the following timeframes:

  • Information about customers and suppliers is stored until 3 years after the termination of the customer or supplier relationship, unless longer storage is necessary, for example, in accordance with the bookkeeping laws (5 years of storage of accounting material), or if the information is necessary for a claim that expires later than 3 years, or a guarantee that extends beyond 3 years.
  • Employment: after the termination of employment, after claims for wages, holiday pay, parental leave, sick pay, pension, tax, or other claims or benefits related to employment are finally settled, or if necessary for claims against the employee, up to 5 years from the claim's emergence.
  • Recruitment: after the conclusion of the recruitment round, unless the candidate is relevant for positions within the next 3 months or unless the candidate has consented to longer storage.

Your rights

You have the rights listed below, which you can exercise by contacting us via the contact details above. Your request will be answered free of charge, as soon as possible and no later than one month after receipt, but up to two months if necessary due to the complexity of the request or the number of requests.

  • Withdraw consent. To the extent that the processing is based on your consent, you can withdraw it at any time by contacting us at the above contact details or in another manner explained in connection with giving consent. The withdrawal does not affect the lawfulness of the processing before the consent was withdrawn.

  • Access. You have the right to access the personal data we process about you, as well as a range of information about how the processing takes place. Access cannot be requested to information that should give way to public or private interests, including considerations for you.

  • Rectification. You have the right to have incorrect personal data corrected or incomplete personal data about you completed.

  • Erasure. You have the right to have information about you deleted under specific circumstances listed in GDPR Article 17. For example, if the information is no longer necessary for the fulfillment of our obligations and rights, or if the information is processed based on your consent, which is withdrawn.

  • Restriction. Under the circumstances mentioned in GDPR Article 18, you have the right to restrict the processing of your personal data, e.g., if the accuracy of the data is disputed, until we have had the opportunity to determine whether the personal data is correct, or if we no longer need the personal data for processing, but they are necessary for our legal claims to be established, asserted, or defended.

  • Objection. You have the right to object to the processing of personal data that we process based on Art. 6, paragraph 1, letter f (balancing of interests) and always if the processing is for direct marketing purposes.

  • Data portability. If the processing is based on your consent or contract, you have the right to receive the data in a common and readable format and to transmit the data to another data controller. We will transmit the data directly to this data controller if you wish and if it is technically possible.

  • Automated decisions. You have the right not to be subject to an automated decision that has legal effect or similarly significantly affects you, which is solely based on automated processing, including profiling.

  • Right to complain. You can complain at any time about the processing by contacting us. Additionally, you can always complain to the Data Protection Agency (http://datatilsynet.dk, dt@datatilsynet.dk, +45 33 19 32 00), or to the supervisory authority in the country where you reside or where you believe the violation of GDPR or the Data Protection Act has occurred.
